Introduction.  Monte Carlo Restaurant Limited (operating as Mamma’s Pizza®, referred to as “Mamma’s Pizza”, “we” or “us”) recognize that privacy is important to our customers.  We operate in a manner that recognizes this and in compliance with privacy legislation that governs the collection, use and disclosure of Personal Information (defined below). This Privacy Policy identifies the Personal Information we collect (e.g. when you place an order by phone or in person, use our web site at “Website”), when you send us an e-mail, register to place online orders, or when you register a Mamma’s Pizza Gift Card), how we use that Personal Information, how we may disclose it, and the steps we take to safeguard it. This Privacy Policy also explains how you can confirm or correct the Personal Information we hold about you.

Updates to the Privacy Policy. This Privacy Policy has been updated as the date shown at the end of the document, and may be updated at any time. Please check periodically for any changes. “Personal Information”.  In our Privacy Policy “Personal Information” means information about an identifiable individual.  This can include your name, physical or mailing address, home or cell phone numbers, email address, credit card information and any other information that would allow someone to identify or contact you.  Your knowledge and consent are required for the collection, use, or disclosure of your Personal Information.

Website Issues.  Our Website server does not automatically record your Personal Information, but we do collect Personal Information from you, with your consent, via the Website, e.g., use the “Contact Mamma” form, register to be an eClub member or when you register a gift card or register to place online orders.  Our Website may include hyperlinks to other websites, and you should know that we are not responsible the privacy policies or practices of their owners or operators.  Please review the privacy policies of any other websites before submitting Personal Information to them.

Collection.   We do not collect Personal Information other than with your consent.  We collect your Personal Information so that we can provide products and services to you, and to help us better understand and serve our customers. Specifically, we collect your Personal Information to:  to confirm and fulfill product orders that you place by phone, in person or online; to optimize your use of the Website; to register you as an eClub customer to receive promotional information; to register your Mamma’s Pizza Gift Cards; and to respond to any inquiries or comments you may send to us.  With respect to online orders, you will be asked to register by providing your name, phone number, e-mail address and mailing address and to create your own password.  When you place an order, your name, phone number and address will be pre-populated.  Please note that certain services (e.g. delivery, online ordering) require the provision of Personal Information.  If you choose not to provide Mamma’s Pizza with Personal Information, some services may not be available.  On eClub e-mails, you will be given the opportunity to unsubscribe, removing your email address from our mailing list.  In addition, at any time, you may contact us as noted under Compliance, to request that we delete the Personal Information we hold about you.

Use.   After we have collected Personal Information we use it to confirm and fulfill your phone, in-person or online orders and to provide products, services or information to you, to respond to e-mail or other inquiries or comments, to help you to register a Mamma’s Pizza Gift Card, and as an eClub member to tell you about product offers and announcements.  We also use your Personal Information to make your use of the Website more efficient for you and to update our consumer profile information.  In some cases, your Personal Information will be aggregated with other information (such that you could no longer be identified) before we use that information.  With your consent, we may use your Personal Information to contact you to determine if Mamma’s Pizza’s products and services meet your needs or inform you about products and services.

Retention:  Your Personal Information is retained as necessary for the fulfillment of the purpose for which it has been collected and used, and will also be retained so that we can efficiently process any future orders from you for products or services.  If you do not wish us to retain your Personal Information please make this request to us, as noted under Compliance.

Disclosure.  Mamma’s Pizza may disclose your Personal Information to its employees and agents (e.g. our third party information technology service providers) and to our franchisees in connection with your purchases from them (e.g. placing a phone, in-person or online order, using a gift card), but in each case, these individuals and organizations are required to comply with our Privacy Policy.  We do not disclose your Personal Information to any other third parties, except as may be permitted or required by law.

Sale or Transfer of Business.  In the event that Mamma’s Pizza’s business is the subject of an asset sale, acquisition, merger, consolidation, divestiture, stock sale, purchase of part or all of the assets of the business, or other corporate transaction, or by way of assignment (whether by operation of law, including bankruptcy, receivership or otherwise), we may disclose or otherwise transfer your Personal Information to a successor of Mamma’s Pizza. In the case of such event, the Personal Information will become the property of the successor and will be subject to the successor’s Privacy Policy.

Accuracy.  Your Personal Information is maintained as accurately and completely as is necessary for the purposes for which it has been collected and is to be used. You have the right to update, modify, amend or correct errors in your Personal Information by contacting Mamma’s Pizza, as noted below under Access and Compliance.

Safeguards.  Mamma’s Pizza uses its best efforts to protect your Personal Information by using a number of safeguards.  Our employees, third-party agents and franchisees who have access to your Personal Information are informed of our Privacy Policy and required to comply with it.  We use reasonable efforts to protect the confidentiality of the Personal Information we collect.  We may store and process Personal Information collected via the Website on our own servers or on the servers of our agents.  Paper copies containing all or part of the Personal Information may be made and kept in file cabinets as part of the course of our normal business activity. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place certain physical, electronic, and managerial procedures to safeguard and secure the information we collect online.  With respect to online transactions, credit card and other Personal Information is protected with additional security, beginning with the “method of payment” screen.  We, or our agents, use security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. We use best efforts to limit access to your Personal Information to those employees, agents and franchisees that need to have access to that information in order to provide the products and services you request to you and as otherwise described in this Policy.

Risks.  You should also do your part in protecting your Personal Information, particularly when you use the Website to register as an eClub member, place online orders or register a Mamma’s Pizza Gift Card.  For online ordering, you should ensure that you keep the password you create confidential. Unfortunately, neither Mamma’s Pizza’s network nor data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect Personal Information, we cannot ensure or warrant the security of it.  As such, any Personal Information you submit to us is provided at your own risk.

Access and Correcting Your Personal Information.  You have the right to review the Personal Information we have collected from you and to correct it.  Upon request in writing, either by e-mail or letter, you will be provided with a copy of the Personal Information we hold about you.  Please contact our Privacy Officer, as identified below under Compliance.  We will assist any customer who informs us that they need assistance in preparing a request concerning Personal Information. You may also correct, in writing either by email or letter, the accuracy of the information and have it amended, or request that we delete any Personal Information we have on file.
